Illegal Downloading - Hadopi and You

INTRODUCTION
Most of us have music and movies on our computer instead of buying CD’s and DVD’s.
How do we get them? We, mostly teenagers, download it illegally, pirate it.
Indeed, most of us prefer to download on the Internet rather than spending money on CD or DVD, but this action has a cost and has negative effects on the music and movies industries, but also on the society.
That is the reason why the French government decided to introduce a new law in 2009 aiming at controlling and regulating internet access. This is HADOPI.
What are the issues of this law?
QUESTIONS
1) What is copyright? How long does the copyright last?
So, it is a type of property that is founded on a person’s skill and labour. It is designed to prevent the unauthorized use by others of a work.
2) What download software do you use?
Those software are Peer to peer (P2P), it is a network protocol for computer users, used for downloading torrents or P2P files. Rather than connecting to the Internet, P2P software allows surfers to connect with each other to search for and download content.
P2P is legal but if you broadcast protected copyright works, this becomes an illegal use.
3) Let’s take the example of downloading music, what are the consequences of illegal downloading for the music industry?

5) Who controls illegal downloading?
6) What happen to people who download illegally very often?
When Hadopi would start, how many French internet users could have their internet cut off?

We have seen that Hadopi is a law against / for the illegal downloading adopted by the Senate in June 2008 / May 2009 / October 2009 that consists in controlling and punishing people who use illegal downloading. According to the « réponse graduée » method, people can be emailed / receive a phone call / be sent a letter but also can be cut of their internet access.
Hadopi was completed by a new law called Olivennes law project / Hadopi 2 adopted in September 2009.
Since the government created the Hadopi law, most people, mostly teenagers, still download illegally, even if they know what can be the risks, it seems clear that they don’t really feel concerned by the law.
The Hadopi law is a good project to change mentalities, bad habits about illegal downloading, also for the music and movie industries but, does this new law really work? Does it reduce illegal downloading? Is this law truly adapted?

ReplyDelete1. Copyright is a form of protection provided to the authors of “original works”.It only protects the specific and original expression of the idea.
In the US and in most European Countries Copyright, in general, lasts until 70 years after the death of the creator.
2. We use Emule, Limewire.
3. The consequences are that by downloading, artists don't receive their copyright
4. Is a French law introduced during 2009 as a means to control and regulate internet access and encourage compliance with copyright laws.
5. These are rights holders who identify and report the IP addresses of surfers using platforms or illegal sites to download.
6. They can pay until 300,000 € fines or possible three years’ jail.
50,000 French Internet users could be forced offline when Hadopi would start warning illegal users.

ReplyDelete1. The copyright is a kind of protection of the artistical work of somebody (movies, cd's, books, paintings etc...). It provides the others to copy the author.
2. I use sometimes Limewire, but now, it doesnt work anymore, so I have to change :(

4. Hadopi is a French law against illegal downloading, it is promoting the distribution and protection of creative works on the internet, and this law was created in 2009.
5. The "high autority" (haute autorité) is controlling illegal downloading on the net and the Comission de Protection des Droits (CDP), which are alike "policemen".
6. A e-mail is sent to the persons who download too much. At first, it is just some "warnings". Then, the Hadopi law can decide to cut the internet access for a year, and make pay a fine, or even go to jail.

1)A Copyright permits to the authors to show that their idea is an original idea, so in theory their idea can't be stolen because that is proved they are the first who had it, who find it. (ideas for example for movies, misic, literature, ...)
The copyright lasts 70 years after the authors's death.
2)I don't use any download software sorry (yes it does exist)
3)The consequences of illegal downloading for the music industry are that the artists are not paid for the work they do. People want to have everything on a free way. The music industry doesn't receive benefits for every song we download, so it could be seen as: every music we dowload is lost money for the singer that made it. We can see, on an extreme way, that following those practicies could conduce them to their 'ruin'
